Settlement Agreement

Divorces, separations and termination of cohabitation relationships can be prohibitively expensive if not settled as soon as practically possible. These usually relate to monetary matters like the amount of maintenance for children, division of assets, the communal home, etc. Sometimes, fundamental issues of principle, like a refusal by a party to pay maintenance, can cause the settlement process to become deadlocked, necessitating the implementation of unique strategies to overcome the obstacle.

Depending on our initial assessment, negotiation might be started as soon as possible or if deemed inappropriate, the parties could be referred for mediation in an effort to settle their disputes. Once a degree of normality is restored, a first concept Settlement Agreement is drafted. Discussion between the parties, as facilitated by their respective legal representatives, continues until both parties are ready to sign a final Settlement Agreement.
